INTESTACY OF AN ESTATE (WHERE THERE IS NO WILL)

WHAT IS INTESTACY?

When a person dies without a valid Will in place, they are said to have died intestate. A Grant of Administration Intestate is the document issued by the High Court Probate Office, after an intestate estate has been administered. It is the document that gives the Administrator(s) the authority to deal with the assets of the deceased person. For example, bank accounts can be closed, and property can be sold. Then, the Administrator distributes the assets of the estate in accordance with the laws of intestacy. After the first consultation, we will provide a full transparent fee structure of the legal costs and the outlays that will be incurred in the transaction.

OUR SERVICES INCLUDE BUT ARE NOT LIMITED TO:
  • Writing to solicitors in the County to locate a Will.
  • Advising the Administrator on the legal requirements to obtain a Grant of Administration in Ireland.
  • Advising the Administrator on the rights of all Irish beneficiaries, the obligations and scope of the role.
  • Getting all Irish accounts and Irish assets of the deceased valued, except property.
  • Registration of notification of death for Irish shares and pensions held in the sole name of the deceased.
  • Submitting the application to the Probate Office. 
  • Transfer of all Irish assets from the name of the deceased into the name of the beneficiaries, excluding shares.
  • Preparing an estate distribution account.
  • Paying funeral costs or the Fair Deal, from funds held if required.
  • Paying all beneficiaries entitled under Intestacy.
